"today in the bay's" christie smith joins us live. we understand you spoke to the victim's family and they say he's a victim of mistaken identity. >> reporter: that's what at least one sister believes. i just spoke briefly with the stepdad who was so upset he had very little to say but i can tell you that he lives right near where this happened. i want to step aside. he lives in this unit here. you can see one officer there is where this shooting took place. the sister believes this young man may have been targeted because he just wasn't from here. she says there was a commotion outside of the unit and she spoke with him before that. next thing you know there was gunfire in the streets. one neighbor believes that this was likely gang related just because of the people who live around here. the shooting started around 12:16. neighbors called 911. they heard multiple shots fired. when deputies arrived, they found a 17-year-old down on the ground. those deputies tried cpr but it was too late. the sister said he had just

celebrated his 17th birthday only a couple days ago. and had only been in the area for about a week. >> it was his first birthday. first christmas being with the family. first time being with the family. >> reporter: how long has he been staying with you? >> a week. about a week. this is my dad's only son. >> reporter: investigators are saying they don't know at this point why this young man was shot and they also don't have any suspect information. they tell us this is the first homicide of the year for marin city. reporting live in marin city, christie smith, "today in the bay." 6:02 now. new this morning, los angeles police say 14 people being held hostage inside a nordstrom rack are now free. officers say a pair of armed men entered the store overnight. s.w.a.t. teams surrounded it for four hours before going inside. inside they found 14 store

employees hiding in bathrooms and locked in storage areas. the robbers were nowhere to be found. police are trying to determine what kind of weapons the men are armed with. a south bay family says investigators are not doing enough to find the person that killed their son three weeks ago leaving his body on the side of the road. 24-year-old jacksen madsen's body was found on san tomas presbyterian in campbell three base befo days before christmas. police say it appears to be hit-and-run but who hit him remains a mystery this morning. madsen's friends say he may have gotten in a fight at a bar in downtown campbell and then there's a 911 call campbell police say came from madsen's cell phone a short time before his death. >> to know that he had a 911 call and was from his cell phone him huffing and puffing like he's running from something. that's the only thing i can

think of. it won't get out of my mind. >> the chp says it has specially trained investigators working on the case. officers are calling it a top priority. it is back to square one in the search for san jose's next police chief. current chief chris moore is retiring one week from tomorrow. the three possible replacements were rejected by a panel of community leaders on wednesday. the city is now coming up with transition plans. 6:04. help is on the way for commuters caught in that bumper to bumper backup on the dumbarton bridge. you may have noticed since the start of the year the commute from the fremont side of the bridge to the menlo park side has been especially bad. "today in the bay's" bob redell is live with the reason for the gridlock and what's being done to clear it up. >> reporter: good morning to you, laura. it's a commute that's gotten worse this week as more people have gotten out of holiday mode and started going back to work. anyone that covered the dumbarton bridge knows the problem. it's the middle toll lane which you can't see but you can see

above this semi the closed sign indicates a lane is shut down. toll lane number four that's been shut down since the beginning of the new year because of budget cuts. they haven't been able to man it with a toll taker and more people have had fewer lanes to use creating a backup that has gone as far back reportedly as 880. that's a significant distance. what's happened right now, our traffic anchor talking to shortly did speak with someone authorized to speak on behalf of the bay area toll authority and yesterday they told us that they are evaluating the situation. they will have somebody out here today to look at what the traffic backup is. and then over the weekend they may come up with one or two solutions that could be possibly put in effect as early as monday. one solution is let's find the money and restaff that position so that toll lane is open and we don't have the backup. the other is making that lane a fastrak only lane. that technology is in place there. they could simply flip the

switch and make that fastrak only it wouldn't be cash but it would be fastrak only which of course would be better than no lane at all. i mentioned we want to speak with traffic anchor mike inouye. thank you for getting us that information. as far as today's commute is concerned, we know it's friday light so perhaps maybe the backup here won't be as bad as it has been earlier days in the week. i don't know what your screens are showing you right now. >> thank you, bob. a typical friday commute over there. the build happens just after 7:00. we'll continue to track that. thanks to our viewers that brought it to our attention. hopefully we have no major problems at the bay bridge but we see backup forming already here and that's i'm cautious about the forecast for the backup at the dumbarton bridge. cash lanes at the bay bridge do have the backup. fastrak not a problem. no metering lights yet. we'll show you approach on the maps. smooth flow of traffic in your commute direction. slowing now through berkeley around university and arrow points to that commute direction. other avenues through oakland

just fine. away from the bridge we had a disabled big rig blocking two lanes reported right there at mcdonald avenue. i have in no further updates from chp. they arrived on scene and they cleared. we don't see slowing. that might indicate they moved the big rig. i'll let you know if anything developmen develops through the area. easy drive through pleasanton and sunol on 680. 880 an easy drive. roadways traveling into the south bay a relatively light commute. christina, we had a lot of fog over the last part of this week in the south bay but this morning it looks clearer and colder. what's up? >> it's frost we're tracking more than fog this morning. good morning to you. happy friday. 32 degrees in livermore right now. 29 in gilroy. 33 degrees dropping pretty substantially in santa cruz as

chargers are pending against a man suspected of intentionally starting a deadly five-alarm fire in new york city. officers say the 45-year-old man used to live in the apartment complex that he's accused of setting on fire. investigators say the fire was set after a domestic dispute. the person who died was not involved in that dispute. also on the east coast, investigators reviewing surveillance tape to see why a commuter bus slammed into a school bus in new jersey. we brought this to you yesterday morning as breaking news. the bus was not carrying any children when it toppled on a power supply station in front of an apartment complex. 16 passengers and the driver on the commuter bus were injured when it smashed into a tree. investigators trying to figure out what caused a big rig to fall off highway 29 in vallejo. the rig burst into flames yesterday morning on the roadway before the connector with westbound 37. officers say the rig collided with a pickup truck though it's unclear why. two good samaritans and a

paramedic pulled that driver to safety but he later died from his injuries. the pickup driver was not injured. it appears alcohol and drugs were not factors in that crash. time is 6:13. time for a check of the day's top stories. a 17-year-old boy is dead after an overnight shooting in marin city. the victim's sister says her brother just moved to marin. she believes he may be the target of mistaken identity. all lanes of eastbound 80 are back open after several cars crashed there early this morning. chp says a car spun out, hit the center divide and then was broadside ebroad sided by another car. one man had major injuries. regular nonstop dreamliner service is expected to start today out of san jose international airport. this despite several issues with dreamliner planes in boston and japan. the faa announced a special review of all dreamliner aircraft. 6:14. the flu is at an epidemic level

in some parts of the country. according to the centers for disease control, 135 million doses of the flu vaccine have been made and 120 million has already been handed out. it can be hard to tell if you actually have the common cold or the flu because both have such similar symptoms. colds include runny nose, sore throat, sneezing and coughing. the flu usually includes high fever with chills, headache and you're tired. sore throats are less common with the flu. was america full of it when it came to making medical records electronic. >> they say they were wrong. scott mcgrew is looking into it. anyone benefited from the electronic medical records? >> probably. medical records less likely to make mistakes when computer is watching over them and certainly medical record companies made a

pretty penny on this but the think tank that said america would save tens of billions of dollars by switching to electronic workers say its data shows we haven't saved a penny. because they keep such careful track in some cases, they have added to the cost of health care bills. nurses document every band-aid and aspirin used. the study which its own authors say is inaccurate was the basis for the obama administration's multibillion dollar push for modernizing hospital medical records. where can you save money? today is the first day walmart will sell you an iphone 5 with no contract. $45 a month for unlimited data, talk and text. that's a great deal. i can't speak for coverage. it's through walmart's straight talk service. make no mistake. the iphone 5 is not cheap. it will cost you about $650. the calculation is overall savings is about $1,000 a year.

san francisco facing controversy this morning over its decision to pull an award at the consumer electronics show for dish network's new hopper device that allows recording of tv shows. in a press release it says it was asked to pull the award by the parent company cbs, which is suing dish over that same service. dish responded with this statement. we're saddened that staff is being denied the editorial independence because of cbs's heavy handed tactics. jim mcafee back in the news this week. this weekend one of my guests lived with mcafee at his compound with the girls and the guns. here he is describing a scary moment with mcafee playing russian roulette at the kitchen table. >> he opens the chamber out. takes the bullet out. takes one bullet. puts it in the gun and spins it.

lanes, chp closed that incident. countercommute things are just fine. commute good as well. racetrack as folks come off the bridge and merge with interstate 80 approaching the bay bridge. a smooth flow of traffic through the toll plaza itself. and toll plaza shows now the lanes are backi ining up. metering lights are on. build is the key word as traffic backs up toward the 880 over crossing off the berkeley curve. we'll look at your maps and show you the view through oakland with 580 and interstate 880 both moving smoothly. warriors play the trailblazers tonight. that doesn't affect the commute because friends that work for warriors aren't up yet. gradual build through livermore. 680 through pleasanton no problems south for the commute. south 880 is picking up volume so you'll see slowing now coming into and through fremont out of hayward. south bay itself we have that burst sticking around for north 101 from 680 up to the airport.

morning, january 11th. we'll see how the markets will end our week checking those numbers in just a bit. first, i want to say good morning to you. i'm laura garcia-cannon. >> i'm marla tellez in for jon kelley. >> it's been a nightmarish week for boeing dreamliner planes. already this week two issues with those dreamliners at boston logan international airport. one a fuel leak and the other a battery that caught fire and now cracks have appeared in cockpit windows of dreamliners in japan. all this as san jose gets set to unveil its brand new regular nonstop dreamliner service later this morning. business and tech reporter scott mcgrew joins us with a new look at service in san jose and words of a federal investigation into those dreamliner planes and problems they're having. earlier this week after the problem first came up you said watch for more and certainly you were right. >> good morning. the one that really started this off small electrical fire in bot boston. you mentioned that.

same model different plane had a fuel leak and cracked windows. the transportation department gets ready for a press conference. secretary ray lahood will be appearing any minute now to talk about the dreamliner and some of the things that the federal government will be looking into. he has ordered a review. he walks up. we'll continue to listen to this in the newsroom and bring you the very latest. all of this comes as ana airplanes set to launch the first nonstop service between san jose and tokyo. a dreamliner inbound for san jose as we speak. it's flight 1076. due in at 9:19. an hour early. they'll turn around and take californians back to cotokyo. the airline had no problem with the 787 last night when we talked to the spokesperson.

>> the problem with the aircraft -- >> reporter: a fire on the airplane on 787. >> that's a different -- not our company. different airline aircraft. we don't have any comment. >> in the hours since that interview they did find cracked cockpit windows in a domestic dreamliner flight that grounded the plane. another oil leak on another flight forced a plane to turn around as well. now obviously the big question is should you put your family on a dreamliner. we're waiting to hear from transportation secretary ray lahood. any flight you take today is going to have something wrong with it. when you catch the captain do that walk around before the flight or first officer if it's raining, they'll always find something. some of this is news finding issues but we are going to hear from the transportation secretary in just a bit. the minute we know something, we'll let you know. >> aviation experts say these are more like growing pains for the new aircraft. >> nearly brand new aircraft.

it just came out from boeing delayed for a number of years. these may be those sorts of things. travelers at sfo may be in for flight delays this month as soon as tonight in fact. construction crews are working on safety upgrades required by the federal government. that means the runway will be shut down for three weekends this month. the first closure is tonight at 10:00 until 8:00 monday morning. the runway closure will have biggest impact on flights within a two-hour radius of sfo. certainly a cold morning out there. want to check temperatures right now with meteorologist christina loren. >> good morning to you, laura and marla. good morning to you at home. they are dropping off. close to freezing just about everywhere and cold enough for frost through all of your interior valleys this morning. you want to travel cautiously over bridges and overpasses where you might find some black ice this morning. if you're headed to southern california low snow we had yesterday is moving into so cal. the grapevine is shut down for

it's a nice drive. we're looking to the bay bridge where we do have a well lit bay bridge toll plaza because metering lights are on and headlights are waiting. mild for a friday. we typically expect this to the end of the parking lot. another live look outside shows you approach coming through oakland northbound with taillights. smooth drive here and southbound toward the san mateo bridge. without any major issues. we'll show you the maps and slowing northbound routes for 101. 87 from capital into downtown and highway 85 off 87 coming up to the interchange. northbound commute is on for the south bay. northbound 680 toward scott creek road in the center of your screen we do have a new crash reported involving a big rig. this may be off at the off-ramp. if you don't use scott creek, it may not be an issue. we'll see slowing past the miniature golf course. my kids know about that one. drive through livermore smooth drive for freeways and power outage reported for the area. dublin, livermore, pleasanton. 2,500 customers affected.

welcome back, everyone. what a beautiful live look outside this morning. sun arriving over the bay area. glorious bay bridge. it's friday morning too. it is 6:39 right now. relatives of four people killed in a plane crash alongside jenni rivera are suing the singing star's company. the families say rivera was negligent when she hired what they say was a faulty lear jet. rivera's publicist, a makeup artist, her stylist and her lawyer along with two pilots were killed in the crash december 9th in northern mexico. arsonist is caught on camera setting fire inside an apartment complex in irvine.

security video shows that suspect setting the fire you see there under that couch. police say the suspect lit the fire to force people out of their apartment units so he could burglarize them. no one was injured but the suspect is still at large. a shocking sight to wake you up on this friday morning onboard a flight from australia to new guinea. a snake on the plane. the nine-foot python appeared on the plane. the flight arrived safely but the snake did not. it was found doa, dead on arrival. >> don't want a window seat anymore. it's 6:40 right now. up next, held up at gunpoint and then held as hostage. employees locked inside a nordstrom rack has gunmen roamed the store. a teenage boy new to town is shot and killed in marin. why his sister says he's the target of mistaken identity.

6:43. another update to breaking news we've been following this morning for you in marin where a teenage boy is dead after an overnight shooting outside his home. this morning the gunman is still on the loose and sheriff's deputies are asking now for the public's help. right now officers have fanned out near cole drive in marin not far from golden gate recreational area.

christie smith joins us live where she just spoke to the victim's family. >> reporter: good morning. understandably that family is very upset this morning. they say the 17 year old had some rough spots in his life but that he was basically a good kid. i want to step aside so you can see exactly where this happened. investigators taking measurements this morning by where he was shot. now, what the family is saying is he only just turned 17 years old about four days ago. his sister says there was a commotion outside of the home and a guy outside of the home acting strange in her words. next thing you know there was gunfire. this was around 12:16 this morning on drake avenue. this is an area with a lot of apartments, public housing. police say he was shot two to three times. witnesses tried to help. deputies arrived very quickly and tried to administer cpr but it was too late. he died at the scene. the family tells me he's from weed, california, and only been here for a week or two. one friend of the city said she

is live with the reason for the bumper to bumper traffic and what's being done to clear it up. bob, good morning. >> reporter: good morning to you, marla. we're on the approach right now to the dumbarton bridge. it is friday light. we're not in full commute hour. as we approach the dumbarton toll plaza, look straight in front of us. you'll see one of the middle toll lanes, number four lane, has been shut down since the beginning of the year because of budgetary reasons because they didn't have money they have not been staffing it and as a result it's been closed during the commute hour which is usually 7:00 to 9:00. we're not in it yet as i mentioned. tremendous backup. some reports of the backup extending all of the way back to 880 which is quite the distance. so what is going to happen? mike inouye did talk to someone able to speak on behalf of the bay area toll authority and they have had people out here. they are going to have people out here today to evaluate what the traffic backup is.

over the weekend they'll look at a couple options and perhaps as early as monday they would implement one of those option the. one could be let's find the money and refill that position so we can get somebody into that toll plaza or two, this toll plaza number four lane is equipped with technology to go fastrak only. we could at least have it fastrak only. would it be cash? no but fastrak only would be much better than having it closed and having a backup. if you are going to take dumbarton bridge as you can see right now, it's friday light and as we head westbound through the toll plaza you can see traffic is at the limit. no problems right now. what will it be in the next few hours? i don't have a crystal ball. hopefully typical friday morning commute. reporting live westbound on dumbarton bridge, bob redell, "today in the bay." >> be safe out there. it's not just dumbarton bridge making headlines today. >> in fact, several transit agencies dealing with issues throughout the bay area. if you use a clipper card, your personal privacy may sooning better protected.

metropolitan transportation commission is exploring options to reduce the length of time it holds onto your personal data to three years. a bay citizen report found the mtc can store personal information for up to seven years. the mtc also says only 44% of its closed circuit television cameras are working. just 49% of traffic sensors are actually working. and only 61% of electronic message signs are in use. all of these systems were managed by caltrans. the state transportation agency. mtc wants a bigger role in managing these systems and mtc committee will discuss an issue during a meeting today. samtrans is changing scheduling dimes affecting depart our and arrival times. no routes will be changed. all of those changes will start on sunday. visit samtrans.com for specific information.

crucial decisions in court in two high profile cases. starting in the east bay, a young man will be sentenced today after pleading guilty to the gang rape of a teenage girl outside a homecoming dance in richmond. morales faces up to 27 years in prison after pleading guilty in november. mo morales is the second man to be sentenced in that case. four men are awaiting trial. a uc berkeley student law student is pleading guilty related to the beheading of an exotic bird in a las vegas resort. a fellow student faces felony charges of killing the bird. surveillance video shows both students chasing the bird and then tossing its body around. this morning several shooting incidents prompting a conversation about gun control. >> starting where investigators say bullying may have prompted a

shooting at a high school campus in the city of taft. a teacher and another staffer talked the teen into putting down his gun. the suspect is now under arrest. in colorado, defense attorneys say james holmes is not ready to make a plea to charges of killing 12 people inside a movie theater. they have not revealed why the defendant is not ready. late last night a judge ruled there is enough evidence for holmes to face trial on 166 felony counts including first-degree murder. defense attorneys insist holmes is mentally ill. amid controversy over gun control, one of the largest gun shows in the country will take place this weekend. hundreds of tables will be set up in the south hall for buy, sell or trade guns including high capacity magazines provided they are not capable of holding more than ten rounds. >> after meeting with the nra, vice president joe biden will meet with representatives from the video gaming industry as he
